General Terms

By commissioning me, you are automatically agreeing to the T.O.S. and are subject to any of the terms written thereunder. I will not be responsible for any misunderstandings as a result of not reading the Terms of Service in its full.• I have the right to decline any commission.
• I have my own personal style, please keep that in mind for your artwork
• I have the right to stream the creation process of the model.
• A hush fee of 15-25% the original price will be issued for clients who want to keep their artwork secret during its development.
• Be mindful of the queue when requesting - the fuller the queue, the longer artwork may take.
• Please be respectful that I am a full time student; the current workload of school projects may cause minor delays in start times or work times. The client will be notified beforehand if there may be any schedule delays.

Communication

Regarding your commission, please contact me through email ([email protected]) or on Twitter at @nenedreamir. I would prefer we stay to one of those platforms to ensure linear, smooth communication.You may reach out at anytime for questions and concerns, or to ask for updates.
I am also a full time student, so if I am not able to respond immediately please understand I may be in class or studying!

Recommendations

• Have plenty of references of your character(s) & the vibe of the illustration ready - Whether it be reference sheets, previous artworks, pose ideas, moodboards, etc., I prefer working with a lot to go off of rather than nothing! Please have at least a character reference sheet ready for me.

Payment

All payments are done in USD via Paypal Invoice. When requesting for a commission, please provide your email so I can email the invoice.

[Live 2D Models]
• 15% Non-Refundable Reservation fee. This ensures clients do not flake out on the process - please be 1000% sure you want to work with me before requesting.
• 45% Prior to the start of the commission
• 40% After the final-check on the draft/sketch
TLDR: 60% must be paid before I begin, and 40% after I complete the sketch and we finalize the details of it!

[Other]
• Payments must be made in-full upfront.
• If a commission exceeds $100, the client may request to do a 50/50 payment plan. 50% of the payment would be given upfront, and the other 50% would be given after the final draft has been finalized.
• Commercial work will require a 15% non-refundable reservation fee, and may follow the same payment plan as Live2D Models.

Refunds

• Full refunds of the first payment are only available before I start on the commission work/ before the work has been marked as “in progress.”
• If the client requests a refund and cancels the service during the drafting phase, they will only receive 50% of the first payment as I also invested time and effort into the piece.
• After finalizing the draft, refunds are not available unless initiated by me.
• In any of the above situations, The client will pay the refund fee and I have the right to alter and repurpose any of the artwork or designs I have currently made.
• Reservation fees are not refundable.If for any reason I am unable to complete the commission due to various circumstances on my side, I will issue a full refund to the client.

General Workflow / Checkpoints

[Live2D Model]
Estimated time: 2 to 8 weeks (depends on complexity)• Commission Request - Client sends me request through email or through Vgen. Please include your name, email for Paypal, which service you'd like and a description, and any appropriate references.
• Contacting Client - I will contact the client so we can further discuss details on the commission, and once all details are agreed upon, I will send the invoice for the reservation fee.
• Reservation Payment - The client will pay the 15% the total amount for a slot reservation. This does not guarante an immediate start, but holds the slot until I am able to begin.
• First Payment - The client will pay 45% of the total amount before I begin. If I am prepared to begin immediately, the reservation fee and first payment can be made together.
• Drafting - During the drafting phase, I will create a mockup of the idea with a sketch and rough colors and rendering. During this process, I will keep in close contact with the client to ensure it follows the lines of their request.
• Second Payment - Once the draft is finalized, the client will send the remainder of the payment. This must be sent before I finish the rest of the model.
• Line Art & Colors - Throughout the process, I will check with the client that they are satisfied with the lineart and base colors. Parts are drawn seperately during this step. After this step is finalized, the lineart and base colors will not change.
• Rendering - I will check with the client with each part (face, hair, body, clothing) of this phase. This is the final stage of the commission.
• Delivery - The client will receive a PSD file with the model ready to rig, as well as a PNG of the model with a transparent background. If necessary, a PDF file with model notes will be included.

• Second Payment - In case of a 50/50 agreement, the client will pay the other half once the draft is finalized.
• Line Art & Colors - Throughout the process, I will check with the client that they are satisfied with the lineart and base colors, and make modifications accordingly. After this step is finalized, the lineart and base colors will not change.
• Rendering - I will check with the client with each part (face, hair, body, clothing) of this phase. This is the final stage of the commission. For YCH or emotes, this step may not be necessary.
• Delivery - The client will receive full resolution PNGs of the artwork. For illustrations, the client will also receive watermarked versions for posting on social media.

Revisions

[Live 2D] If your rigger needs revisions during the rigging process, please put them in contact with me. I will not charge extra fees for revisions the rigger may need in order to do their job!

During the drafting phase, clients may request any amount of revisions necessary (free of charge) to ensure they are satisfied with the artwork as long as it is not too far off from the original request. Total re-drafts may result in an additional fee.After the draft is finalized, clients can request minor modifications during the proper steps. Any major revisions (redraws, complete re-renders) may require an extra fee.

Delays

Possible reasons for delays include:
- Delay on your part to make payments
- Making revisions
- Delays in communication on your part
- Delays on my part due to various circumstances. In the case of delays on my side, partial refund options can be discussed. Please see the REFUND section for more info.

Usage

You MUST credit me, Nene Dreamir, as the artist in appropriate placement where the artwork is displayed. If I am the artist of your model, you much credit me on your social media websites.

You, the client, may use the commissioned artwork for:
(a) Personal Use - profile picture on social media, banners, posts
Live 2D Only: Basic Commercial Uses, including streaming and content creation on websites like Twitch, Youtube, Tiktok, and X.You, the client, are NOT allowed to:
(a) Use the commissioned work for Basic Commercial uses. This includes streaming and content creation on websites like Twitch, Youtube, Tiktok, and Twitter/X.
(b) Use the commissioned work for Extended Commercial Uses - This includes using my artwork on digital/physical merchandising, prints, keychains, acrylic stands, clothing items, etc, as well as having it behind a subscription paywall (Patreon, Youtube membership exclusive content, etc.). This MUST be discussed with me first, and with inquire an additional fee of 50% to 200% of the original price.
(c) Use my artwork for AI (artificial intelligence) tools, platforms, or programs; ML (machine learning) tools, platforms, or programs; AI or ML training; NFT; blockchain; or other for-profits platforms/purposes. These are strictly prohibited and will immediately cause the client to be blacklisted for future work.

Intellectual Property Rights

ARTISTI, as the artist, retain all rights and authorship to my artwork.- I retain the right to post commissioned work on my social media and portfolio. If you wish to not be shown anywhere, or want me to wait before posting, please notify me.CLIENTYou, as the client:1. Cannot claim the artwork as your own or anyone else's.
2. MUST credit the artwork back to one of my social media platforms (twitter, twitch), vgen, or website.
3. May NOT resell my artwork.
4. If planning to transfer ownership, you must contact me first.You may use the finished commission for the intended purposes below:
• Personal Use
• Display on social media accounts for promotional purposes that don't directly monetize the client (profile pictures, banners) and streaming purposes.
